TERMS OF USE – HOMEWORK BUDDY

 

Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Homework Buddy (“Homework Buddy,” “Company,” “we,” “our,” or “us”) regarding your access to and use of our website, mobile applications, software, and all related services (collectively, the “Services”).

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.

Our Services are designed to be accessible for users of all ages. However, certain AI tools and features are structured so that a parent or guardian is the primary account holder and manages signups. If you are under the age of majority in your jurisdiction, you may only use the Services with the knowledge, supervision, and consent of a parent or legal guardian.

1. Our Services

Homework Buddy provides AI-powered educational support tools designed to assist with study, revision, and problem-solving.

You acknowledge and agree that:

  • The Services are intended to enhance learning but are not a substitute for human judgment, teacher instruction, or verified educational resources.
  • Homework Buddy actively trains its tutoring agents and AI systems to minimize errors, omissions, and incomplete or misleading information, and implements safeguards to improve quality and accuracy.
  • Despite these efforts, Homework Buddy cannot guarantee that all information generated will be accurate, complete, or suitable for every purpose.
  • You remain solely responsible for verifying any information, facts, or recommendations provided through the Services before relying on them.

2. Intellectual Property Rights

All content, features, functionality, software, code, databases, designs, text, images, audio, video, and other materials made available through the Services (collectively, “Content”) are the exclusive property of Homework Buddy or our licensors.

We grant you a limited, non-transferable, revocable license to use the Services for personal, non-commercial educational purposes only.

Any unauthorized reproduction, distribution, or exploitation of our Content or Services is strictly prohibited.

3. User Responsibilities

By using the Services, you agree that:

  1. Any information you provide will be accurate and complete.
  2. You will not use the Services for unlawful, harmful, or fraudulent purposes.
  3. You will not attempt to interfere with the proper operation, security, or integrity of the Services.
  4. You will not misuse AI outputs in violation of academic integrity policies, laws, or regulations.

4. Purchases, Subscriptions, and Payments

If you purchase or subscribe to paid features, you agree to provide accurate billing information and authorize Homework Buddy to charge your payment method on a recurring basis until you cancel.

Subscription fees are non-refundable except where required by law.

5. Prohibited Activities

You agree not to misuse the Services, including but not limited to:

  • Circumventing security features, introducing malware, or harvesting user data.
  • Using the Services to generate unlawful, harmful, or misleading content.
  • Submitting AI-generated work in violation of academic integrity rules.
  • Attempting to reverse-engineer or exploit the Services for competitive purposes.

6. Disclaimers

The Services are provided on an “as is” and “as available” basis. You acknowledge and agree that your use of the Services is at your own risk.

Homework Buddy takes reasonable steps to train its AI systems and tutoring agents to minimize inaccuracies, biases, and incomplete information, and employs safeguards to improve reliability. However, we cannot and do not guarantee that all outputs will be error-free, accurate, or suitable for every purpose.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Homework Buddy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
  • Our total liability, if any, shall be limited to the amount you paid (if any) to Homework Buddy in the six (6) months preceding the claim.

 

8. Indemnification

You agree to defend, indemnify, and hold harmless Homework Buddy, its affiliates, directors, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including attorneys’ fees) arising out of or related to:

  1. Your use or misuse of the Services;
  2. Your reliance on AI-generated outputs;
  3. Your violation of these Terms or applicable law;
  4. Your infringement of any intellectual property or other rights of third parties.

While Homework Buddy strives to reduce inaccuracies by training its tutoring agents and refining its AI systems, you acknowledge that no AI is perfect and agree that you are ultimately responsible for how you use the information provided.

9. Privacy and Data

Our collection and use of personal information is governed by our Privacy Policy. By using the Services, you consent to such collection and processing.

10. Modifications and Interruptions

We may update, modify, or suspend the Services at any time without notice. We are not responsible for any disruption or loss caused by downtime, maintenance, or updates.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any dispute shall be resolved exclusively in the courts of South Africa, unless otherwise required by mandatory arbitration or consumer protection laws.

12. Miscellaneous

These Terms constitute the entire agreement between you and Homework Buddy regarding use of the Services. If any provision is held invalid, the remaining provisions remain enforceable.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision.
